Sec 27-85(i)(2):

Provides an industry standard recovered materials container in a common area on the property that is as convenient and accessible to the residents as garbage collection containers. If the city manager or designee determines the location of recovered materials containers fails to meet this requirement, the city manager shall determine an appropriate location on the property for recycling containers;

 

The above ordinance states that recycling shall be provide in “A common area i.e. singular NOT plural

 

Code Enforcement however is choosing to interpret the next phrase (as convenient and accessible to the residents as garbage collection containers) to require that recycling be by ALL garbage collection containers.

 

The citation is for Oxford Manor, a sprawling (all one story or townhouse) 360 apartment community built in the early to mid 1980’s with over a dozen dumpsters locations thru out the community (see map) which we have invested a great deal of resources to beautify (see pix). In many locations there simply is not the space to put recycling containers and every location adds to pick up costs which in turn gets past on in rent, rents already impacted by Gainesville double digit increase in property taxes, one of the most regressive taxes.

 

As City Manager; I implore you to take a reasonable interpretation of the ordinance and ask Code in enforcement to cease and desist.
