Mr. Persons,
Please see the attached reaponse to the Root Kava complaint.   The owner advised that he will be refraining from any loud music until he can figure a way not to disturb the neighbors.

Thank you,
Jaime

Chief –

I spoke with Mr. Kyle Mathey this morning. He was very helpful. He was appreciative of GPD’s response to this matter.

I conducted research and found several complaints. GPD has been on these complaints and confirmed a violation. The officers received compliance from the business and chose to provide a verbal warning according to call notes.

I met with Lt. Cardwell – and asked for the following to occur:

  1. Advise them of the complaints GPD has received
  2. Educate the business (providing GPD Policy and city ordinance)
  3. Explain the next steps if this continues to be a problem
  4. Have DTU connect with the business owners; connect to Downtown business owners meeting; build relationship to understand how this impacts the other businesses and the quality of life in the area

Opportunity**I will be messaging to the shifts the importance of properly handling noise complaints according to the policy.

Lt. Cardwell made contact today – please see attached email with results.

At this time, the direction will be to cite the business properly if violation occurs. The business has advised Lt. Cardwell that they will not be hosting events to prevent further complaints.

I communicated the results of this to Mr. Mathey. He was appreciative for the follow up.

Please contact me if you have any additional questions.

Chief of Staff,

Last Wed, EA Wyatt & I spoke to Kyle Mathey (850-544-0005), concerned about continuing nose violations from a nearby relatively new business.

Mr Mathey indicated residents such as himself of West University Lofts, 120 SW 6th Street, have called dozens of times related to noise violations from Brews & Root Kava Cafe, 615 West University Avenue.

Mr Mathey indicates the outdoor non-enclosed space is directly adjacent to the residences. It has had DJ led outdoor events since approx. January between 1-3x a week. It appears Mr Mathey has followed through on resolution attempts including speaking with lead employees on site (potentially the owner / manager potential name "Bech.")ecent  calling & speaking with police, & having noise turned down. He indicated employees may have misunderstanding of ordinance applicability including times thinking the ordinance doesn't apply until 10pm & noise enforcement may be more difficult due to unrelated ambient road noise along University Avenue.

I encouraged him to have him or neighbors continue calling & consider actions the West University Lofts may avail themselves of. Mr Mathey praised the actions of a recent responding officer who he felt was attempting to address.

Please apprise the City Manager & recommend having GPD / Codes call this week & work with the business, if not already done, on noise mitigation strategies as well as ordinance understanding. Thanks for considering.

Ed Book

City Commissioner
